Terms of Service

These Terms of Service (“Terms”) govern the use of the Vaelico service (“Service”) and the vaelico.ai website, provided by VAELICO STUDIO, S.L., CIF B27669050, with registered address at Calle Gregori Casasempere Juan, 10, Esc. 1, 6º, Puerta 1, 03802 Alcoy (Alicante), Spain (“Vaelico”, “we”, “us”). By registering for or using the Service you agree to these Terms. If you don’t agree, please don’t use the Service.

1. The service

Vaelico hosts AI models for interactive fiction, roleplay and image generation, and offers them through a web app and an OpenAI-compatible API. Available models, limits, and features may change over time as we improve the Service.

2. Registration and account

You need an account to use the Service. You must provide accurate information and keep your credentials secure. You’re responsible for activity under your account. Tell us right away at hello@vaelico.ai if you suspect unauthorized access.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account.

3. Plans, pricing, and renewal

  • We offer a Free tier and a paid Pro subscription; current pricing and limits (text and images) are shown on our pricing page. Paid plans get higher limits and priority in the image queue.
  • Paid subscriptions renew automatically for the same period (e.g. monthly) unless cancelled before the renewal date.
  • We also sell one-time credit packs for image generation; they’re added to your balance right after payment and never expire.
  • Prices are shown before tax; taxes may apply depending on your country and will be added at checkout where required.
  • We’ll give reasonable advance notice by email before any price change takes effect for existing subscribers.

4. Delivery, refunds, cancellation, and right of withdrawal

Delivery policy. Everything we sell is a digital service: nothing is shipped. Pro is activated on your account automatically as soon as our payment provider confirms the payment, usually within seconds and always within 24 hours; credit packs are added to your balance the same way. If your plan or credits aren’t active 24 hours after a successful payment, write to hello@vaelico.ai and we’ll activate them or refund the charge.

Returns and refund policy. As there’s no physical product, there’s nothing to return. If we charge you by mistake, charge you twice, or fail to deliver what you paid for, we refund the full amount to the same card, normally within 5–10 business days depending on your bank. To request a refund, write to hello@vaelico.ai from your account email with the date of the charge. Unused time of a subscription you cancel isn’t refunded: you keep Pro until the end of the period you’ve paid for.

Cancellation. You can cancel your subscription at any time from your account settings; cancellation stops future renewals and takes effect at the end of the current billing period.

Right of withdrawal. If you’re a consumer in the EU/EEA, you have the right to withdraw from a purchase within 14 days without giving a reason, under Directive 2011/83/EU as implemented in Spain. Exception: because the Service is digital content not supplied on a tangible medium, this right is lost once we’ve started providing it with your prior express consent and your acknowledgment that you thereby lose your withdrawal right — which you give by ticking the consent box before paying. Where the right still applies (e.g. you haven’t started using what you paid for), contact hello@vaelico.ai to request a refund.

5. Your content and how we use it

What we store. To provide the Service we store your account, your synced chats and the images you generate together with their prompts and settings. You can delete chats and images at any time.

Ownership. You keep ownership of the prompts, characters, and other inputs you submit (“Inputs”) and of the text and images the Service generates for you (“Outputs”), subject to the underlying models’ license terms where applicable.

License to us. You grant us a worldwide, non-exclusive, royalty-free license to host, copy, process and analyze Inputs and Outputs to operate, maintain, secure and improve the Service — including to train and evaluate our AI models. For training we also use interaction signals, such as the ratings and favorites you give images and whether you download, delete or regenerate them. We don’t publish your content or share it with other users.

Training use switch. Training use is on by default. You can turn it off anytime in Settings → Data & training; from then on, nothing new from your chats or images is collected for training. When training use is on, deleting an image from your gallery removes it from your gallery but keeps a training copy; when it’s off, deleting an image also deletes its training copy. Content collected before you turned it off stays in our training data unless you ask us to delete it. API keys have their own training setting. Details are in our Privacy Policy.

Tester program. If you join our tester program (free Pro in exchange for use, feedback and data), training use stays on while you’re in the program.

6. Acceptable use and safety

You agree to use the Service in accordance with our Acceptable Use Policy. Image prompts pass an automatic safety filter; blocked prompts produce no image, and we keep a record of each blocked prompt (its text, your account and the time) to keep the Service safe. That record is kept regardless of the training use switch. We may suspend or terminate access for violations, as described in the Acceptable Use Policy.

7. Availability and disclaimer

The Service is provided “as is” and “as available.” We aim for high uptime but don’t guarantee the Service will be uninterrupted, error-free, or fit for a particular purpose. Image generation may be paused, queued, or moved between our own hardware and cloud GPU providers. AI-generated Outputs may be inaccurate or inappropriate for some contexts — use your judgment.

8. Limitation of liability

To the extent permitted by law, VAELICO STUDIO, S.L. is not liable for indirect, incidental, or consequential damages arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under Spanish or EU consumer-protection law.

9. Changes to these Terms

We may update these Terms as the Service evolves. We’ll notify active subscribers by email or in-app notice before material changes take effect. Continued use after that date means you accept the updated Terms.

10. Applicable law and jurisdiction

These Terms are governed by Spanish law. Any dispute will be submitted to the courts of the domicile of VAELICO STUDIO, S.L., except where you’re a consumer, in which case you may also bring proceedings before the courts of your own domicile, as mandatory law requires.
